Chapter One / Establishment and Objectives

Article 1 (Establishment):
Pursuant to the provisions of the Private Higher Education Law No. (25) of 2016, a specialized university is established under the name (University of Manara for Medical Sciences) in Maysan Governorate, in response to the needs of various sectors of Iraqi society and to contribute to the process of development and reconstruction.

Article 2 (Name and Founding Body):

  1. A university shall be established under the name (University of Manara for Medical Sciences), headquartered in Maysan Governorate.

  2. The founding body consists of a group of nine retired professors holding doctoral degrees.

Article 3 (Objectives):
The university aims to achieve the following:

  1. Promote university culture, scientific research, and prepare qualified individuals in various scientific and human disciplines, while advancing the scientific process.

  2. Revive Arab and Islamic civilization and preserve heritage.

  3. Strengthen scientific, cultural, and research ties with Iraqi, Arab-Islamic, and international institutions and organizations to help fulfill the university’s objectives.

  4. Contribute to significant quantitative and qualitative developments in scientific, cultural, educational, and research movements in various fields of knowledge—both theoretical and applied.

  5. Prepare scientific cadres in various specializations to serve Iraq’s development needs.

Article 4 (University’s Legal Capacity):

  1. The university has legal personality, financial and administrative independence, and full legal capacity to achieve its goals.

  2. The university is a private scientific institution of public benefit.

Article 5 (Study at the University):

  1. Studies at the university are offered in both morning and evening sessions. Applicants must have a high school diploma equivalent to those accepted in similar programs at public universities.

  2. The duration of study at the college is a minimum of four (4) or five (5) academic years, depending on the field of study. Graduates are awarded a bachelor’s degree in their respective specializations.

  3. Instruction at the college is primarily in English. However, teaching in Arabic is permitted in cases where it is deemed appropriate.

 

Chapter Two / University Council

Article 6 (University Council):

  1. The University Council is the highest scientific and administrative authority in the university. It is composed of the following members:

    • President of the University – Chair

    • Vice Presidents for Academic Affairs and Administrative Affairs – Members

    • Deans of Colleges – Members

    • One representative from the founding body who meets the qualifications of faculty members in public universities – Member

    • One representative of the teaching staff – Member

    • Secretary and Rapporteur of the Council – Members

    • One representative of the students from the college/colleges – Member

  2. The University Council shall convene at least once a month. The President may call for an extraordinary session when necessary or upon written request from two-thirds of the members. The quorum for meetings is two-thirds of the members, and decisions, recommendations, and proposals are adopted by majority vote. In case of a tie, the vote of the President prevails.

  3. Minutes of the meetings shall be recorded in a special register and signed by the President and members of the University Council.

  4. The University shall submit the Council’s decisions and recommendations to the Ministry within fifteen (15) days from the date of issuance for review and approval.

Article 7 (Powers of the University Council):

  1. The University Council shall exercise the following powers:

    • Approve admission criteria and determine the number of students proposed for admission at the beginning of each academic year.

    • Approve curricula and submit them to the Ministry, as well as approve and announce final examination results.

    • Award academic degrees to graduates.

    • Form specialized committees to assist the Council in carrying out its duties and approve academic promotions for faculty members.

    • Recommend the opening, merging, or cancellation of colleges and academic departments.

    • Approve budgets, final accounts, and authorize budget reallocation among sections.

    • Set and revise tuition fees as necessary.

    • Donate movable property to universities, colleges, and scientific/educational institutions and offer aid and rewards in coordination with the founding body.

    • Contract with Arab or foreign faculty members in accordance with Ministry regulations, except for wage determination.

    • Approve the appointment, compensation, rewards, resignation, and termination of faculty members and other employees.

    • Approve the fees and rewards for part-time lecturers.

    • Enter agreements with universities, colleges, and scientific institutions related to research inside and outside Iraq.

    • Temporarily suspend classes wholly or partially for up to one week when necessary, provided the Ministry is immediately informed with justifications.

    • Approve the staffing of the university, colleges, and academic departments.

  2. The University Council may delegate some of its powers to the University President.

Article 8 (Appointment Mechanism for the University President):

  1. The University President is appointed by the Minister based on a nomination from the founding body for an initial term of four (4) years, renewable once, in accordance with the conditions set forth in Article (14) of the amended Private Universities and Colleges Law No. (13) of 1996.

  2. The University President shall assume the following responsibilities:

    • Chair the University Council, call for regular and extraordinary meetings, implement Council decisions, and represent the university before official and non-official entities. The President may delegate representation to others.

    • Manage the university’s academic, administrative, and financial affairs in accordance with laws, regulations, and instructions.

    • Sign contracts and agreements approved by the University Council.

    • Approve the decisions of committees related to asset write-off, valuation, and leasing.

    • Nominate deans and heads of departments or academic branches.

    • Approve official travel (inside Iraq) for university staff.

    • Recommend donations of movable property to universities, colleges, and scientific/educational institutions.

  3. The University President may delegate their powers to the Vice Presidents and college deans.

 


Chapter Three / College Council

Article 9 (College Council):

1. The College Council is the highest academic and administrative authority within the college. It is composed of:
– Dean of the College – Chair
– Associate Deans (for Academic and Administrative Affairs) – Members
– Heads of Departments – Members
– One representative from the college’s founding body who meets the qualifications of faculty in public universities – Member
– One representative of the teaching staff – Member
– Secretary and Rapporteur of the Council – Members
– One student representative from the college – Member

2. The College Council shall meet at least once a month. The Chair may call for an extraordinary session if necessary or upon a written request from two-thirds of the members. A quorum requires the presence of two-thirds of the members. Decisions, recommendations, and proposals are made by a majority of those present. In the event of a tie, the Chair has the casting vote.

3. The minutes of the meetings shall be recorded in a special register and signed by the Chair and all Council members.

4. The college shall submit the decisions and recommendations of its Council to the Ministry within fifteen (15) days of their issuance for review and approval.

Article 10 (Powers of the College Council):

1. The College Council exercises the following functions:
– Approve admission criteria and determine proposed student intake at the start of each academic year.
– Approve academic curricula and submit them to the Ministry, and also approve and announce final examination results.
– Award academic degrees to graduates.
– Form specialized committees to facilitate the Council’s tasks and approve faculty promotions.
– Recommend the opening, merging, or closure of academic departments.
– Approve budgets, final accounts, and reallocation of budget items.
– Set and adjust annual tuition fees as necessary.
– Donate movable assets to universities, colleges, and scientific and educational institutions, and offer grants and rewards in coordination with the founding body.
– Contract with Arab or foreign faculty members according to regulations adopted by public universities, excluding the determination of wages.
– Appoint teaching staff and other employees, determine their salaries and incentives, accept resignations, and terminate services.
– Determine remuneration for external lecturers.
– Conclude agreements with universities, colleges, and scientific institutions concerned with research, both inside and outside Iraq.
– Suspend studies wholly or partially for no more than one week when necessary, with the Ministry notified immediately and the reasons justified.
– Approve staffing plans for the college and its academic departments.

2. The College Council may delegate some of its powers to the Dean.

Article 11 (Appointment of the Dean):

1. The Dean is appointed by the Minister upon nomination by the founding body for an initial term of four (4) years, renewable once, in accordance with the conditions set in Article (14) of the amended Private Universities and Colleges Law No. (13) of 1996.

2. The Dean shall assume the following responsibilities:
– Chair the College Council, call for regular and extraordinary meetings, implement its decisions, and represent the college before official and non-official bodies. The Dean may authorize others to represent the college.
– Manage the college’s academic, administrative, and financial affairs according to laws, regulations, and instructions.
– Sign contracts and agreements approved by the College Council.
– Approve decisions of committees related to write-off, valuation, and leasing.
– Nominate heads of departments or academic branches.
– Approve official travel within Iraq for college staff.
– Recommend donations of movable assets to universities, colleges, and scientific and educational institutions.

3. The Dean may delegate powers to their associate deans and department heads.

 

Chapter Four / Scientific Departments and Department Heads

Article 12 (Departments in the Colleges):

  1. The colleges consist of the following scientific departments:

    • College of Dentistry: Department of Dentistry

    • College of Pharmacy: Department of Pharmacy

    • College of Nursing: Department of Nursing

    • College of Medical and Health Technologies, which includes:

      • Department of Medical Laboratory Techniques

      • Department of Radiology and Sonar Techniques

      • Department of Anesthesia Techniques

      • Department of Artificial Kidney Techniques

      • Department of Laser Cosmetic Techniques (to be established)

    • College of Sciences, which includes:

      • Department of Medical Physics

      • Department of Pathological Analysis Sciences (to be established)

      • Department of Forensic Evidence (to be established)

  2. The college has the right to open additional departments after obtaining the necessary official approvals.

  3. The scientific department is the fundamental academic unit in private university education. It is administered by a Department Council and its Head, and must consist of no fewer than seven (7) faculty members, at least four (4) of whom must hold a Ph.D. or equivalent.

Article 13 (Department Council):

  1. The Department Council shall carry out the following duties:

    • Recommend the department’s needs in terms of faculty members, lecturers, technicians, and invite visiting professors.

    • Approve research project proposals submitted by faculty members and suggest means of implementing them.

    • Recommend support for authorship, translation, publishing, and student research, and ensure the necessary resources for implementation are provided.

    • Implement decisions of the College Council as referred by the Dean.

    • Form academic and educational committees as required.

    • Monitor scientific developments and guide faculty members to update and improve curricula.

    • Review curricula content and textbooks, and propose amendments or replacements based on recommendations from faculty members.

    • Supervise teaching methods and performance, ensure that faculty and other staff fulfill their responsibilities, and oversee students’ academic progress at all levels.

    • Propose a plan for training and developing scientific and administrative personnel.

    • Approve exam results and submit them to the College Council with relevant recommendations.

    • Recommend the number and qualifications of students to be admitted to the department, based on its capacity.

  2. The Department Council may delegate some of its powers to the Head of Department.

Article 14 (Head of Department):

  1. The Head of Department presides over the Department Council and is appointed by the College Council upon nomination by the Dean, in accordance with public university regulations.

  2. The Head of Department shall assume the following responsibilities:

    • Chair Department Council meetings.

    • Call and schedule meetings of the Department Council.

    • Supervise the academic affairs of the department’s students.

    • Oversee the conduct of teaching in the department.

    • Monitor faculty and staff attendance.

    • Supervise examination procedures and form exam committees.

    • Propose plans for developing the department’s scientific and administrative staff.

    • Submit recommendations on the department’s academic, administrative, and financial needs.

    • Recommend the appointment of faculty members based on departmental needs.

    • Form academic and educational committees within the department.

    • Encourage scientific research, publication, translation, and participation in academic conferences.

    • Prepare the department’s annual budget proposal.

    • Implement the decisions of the Department Council.

    • Recommend incentive rewards for outstanding staff and students.

 

Chapter Five / The Teaching Staff

Article 15 (Teaching Staff):

  1. The teaching staff consists of the following academic ranks:

    • Professors

    • Associate Professors

    • Lecturers

    • Assistant Lecturers

  2. The individuals listed in item (1) of this article shall be appointed, promoted, and advanced in rank based on regulations issued by the College Council. Appointments must meet the criteria required for teaching staff members at public universities. Additionally, academic promotions shall follow the same procedures used in public universities.

  3. The teaching load for each academic staff member at the University of Manara shall be determined according to their academic rank and in accordance with the regulations followed by public universities in Iraq.

Article 16 (Part-Time Lecturers):

The university may utilize faculty members from public universities, the Technical Education Authority, government employees, and retirees to deliver lectures or contribute their expertise in achieving the university’s goals. This must be done in accordance with the applicable instructions, and with prior approval from their respective institutions in the case of non-retired personnel.

 

Chapter Six / Financial Matters

Article 17 (University Finances):
The university’s finances consist of the following sources:

  1. Contributions from the founding body

  2. Tuition fees

  3. Grants, donations, endowments, and bequests

  4. Revenues generated from the university’s various activities

Article 18 (Right to Invest and Audit of University Funds):

  1. The university has the right to invest its funds in ways that align with its objectives.

  2. The university’s financial accounts shall be subject to auditing by the Federal Board of Supreme Audit.

Article 19 (Tax Exemptions for the University and Faculty Members):

  1. The university is exempt from income tax.

  2. Incomes earned by faculty members or employees from the university are also exempt from income tax.

  3. The university is exempt from customs duties on imports of materials, equipment, devices, spare parts, specialized materials, teaching aids, books, and printed materials that are included in its approved plans and serve its educational purposes.

Article 20 (Distribution of the University’s Net Annual Surplus):

  1. The net annual financial surplus of the university shall be distributed as follows:

    • A maximum of 10% to the founding body

    • A minimum of 15% to support scientific research, including authorship, translation, and publication

    • The remaining surplus shall be used to expand and develop the university’s activities or in any area that helps achieve its goals

  2. The Ministry shall collect from the university a founding license fee (as determined by the Council of Ministers) and an annual fee equal to 1% of the university’s total annual revenue. These collected amounts shall be deposited into the Higher Education Fund at the Ministry’s headquarters.

 

Chapter Seven / Final Provisions

Article 21 (University Degrees):
The academic degrees awarded by the University of Manara shall be considered equivalent to those granted by public universities.

Article 22 (Academic Calendar):
The university shall follow the academic calendar issued by the Ministry for public universities.

Article 23 (Curricula):
The university shall adopt curricula that are equivalent to those used in public universities.

Article 24 (Credit Hours and Units):
The number of credit hours and their units shall be equivalent to those applied in Iraqi public universities.

Article 25 (Examination Regulations):
The university shall implement the same examination regulations followed by public universities.

Article 26 (Absences):
Regulations concerning student absences shall be applied in accordance with the rules followed in public universities.

Article 27 (Providing the Ministry with Required Information):
The university is obligated to provide the Ministry with all essential information needed to fulfill its oversight role, especially the following:

  1. Minutes of University Council meetings

  2. Quarterly and annual reports on success rates, failure rates, and student dropout rates

  3. Any other information requested by the Ministry

Article 28 (Application of Ministry Regulations):
The laws, regulations, and instructions issued by the Ministry of Higher Education and Scientific Research shall apply to any matters not explicitly covered in this internal regulation.
